Terms of Service

These Terms govern your use of the Talkmaxi app and services (the "Services") provided by Talkmaxi ("we", "us"). By creating an account or using the Services you agree to these Terms and to our Privacy Policy.

1. Eligibility and account

You must be at least 13 years old (or the minimum age in your country) to use the Services. You register with a phone number you own and verify it with a code we send by SMS. You are responsible for activity on your account and for keeping your device secure. Your account can be active on one device at a time.

2. Acceptable use

You agree not to use the Services to:

• break the law, or promote or facilitate illegal activity;
• send spam, bulk or automated messages, or messages to people who have not agreed to receive them;
• harass, threaten, bully, defame or impersonate others;
• share content that sexually exploits or endangers children, promotes terrorism or violence, or infringes the rights of others;
• distribute malware or interfere with, reverse engineer, overload or gain unauthorised access to the Services;
• create accounts through unauthorised or automated means, or collect information about other users without their consent.

3. Your content

You keep ownership of the content you send. Because messages are end-to-end encrypted, we cannot see them; you are solely responsible for what you send. For public channels, you grant us a worldwide, non-exclusive, royalty-free licence to host, display and distribute your channel content as needed to operate the Services.

4. Channels

Channels are public broadcasts and are not end-to-end encrypted. Channel owners and admins are responsible for their posts. We may remove channels or posts that violate these Terms.

5. Reporting and enforcement

You can report users, groups, channels and posts in the app. We may suspend or ban accounts and remove content that violates these Terms or the law, or to protect users, with or without notice.

6. Fees and third-party services

The Services are currently free. Your mobile operator may charge for SMS and data. The Services may rely on third-party services (such as app stores, SMS providers and push notification services) subject to their own terms.

7. Availability and changes

We work to keep the Services available but do not guarantee they will be uninterrupted or error-free. We may change, suspend or discontinue features at any time. Emergency calls are not supported: Talkmaxi is not a replacement for your phone service.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

To the fullest extent permitted by law, Talkmaxi will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim will not exceed the greater of the amount you paid us in the past twelve months or USD 100.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms. If we make material changes we will notify you in the app or on this page. Continuing to use the Services means you accept the updated Terms.
